NAGPUR: The Nagpur bench of Bombay high court on Friday fixed the final hearing on NET/SET holders plea, challenging University Grants Commission's notification exempting PhD and MPhil candidates from appearing for NET/SET exam, on January 30. The court fixed the date after petitioner's counsel, Purushottam Patil moved an application to take up the matter on a priority basis.
The petition challenging UGC's decision was filed by Bhupendra Mude and 14 other NET/SET holders. The petitioners claimed that UGC's notification of June 14, 2006, was in gross violation of Article 14 of the UGC Act.
The petitioners alleged that the UGC had earlier taken a stand that NET/SET can't be substituted by PhD or MPhil candidates. However, with this notification, it took a U-turn. As per Section 28 of UGC Act, amendments in the government notification about any exemption in qualifications should be tabled before the Parliament, the petitioners claimed. The court then granted a stay on the notification.
In the last hearing, the court asked UGC to file the main report of Bhalchandra Mungnekar committee, instead of the interim report it had filed. Mungnekar was appointed by the UGC to study the eligibility conditions for post-graduate level teaching. The one-man panel had suggested that PhD and MPhil candidates should be treated at par with NET/SET holders for teaching in senior colleges.
Meanwhile, around 251 PhD and MPhil holders filed an application, requesting the court to consider them as the third party in the dispute. The petitioners argued that the exemption was granted on the basis of the expert committee's recommendations and the UGC notification has not taken away NET/SET holders right. They claimed that NET/SET holders want to restrict the criteria for no valid reasons. They also cited the Madras high court's reference, wherein similar petitions were dismissed.

ITs an intersting plea
Dear Reader(s) Once the recommendations of the expert committee are approved and shown on UGC website and similar plea has been dismissed by Chennai Court, then why this entertainment is going on. Thousands of appointments are done following the new rule. Hon'ble Rastogi(!) Committee also recommended same to promote research in various subjects. Just having PG degree and SET/NET is really a good qualification??? What will be the future of teaching? I must say that m.phil , PhD. + SET/NET is the final solution for it, but those having at least one research degree should be allowed to give SET/NET exam rather than PG students. Thanks.
